Membership Agreement
MEMBERSHIP AGREEMENT
This Membership Agreement (the “Agreement”) is made between the undersigned member (“Member”) and The Four Fitness Crew Pte. Ltd. (Registration No: 202301339R) hereon after referred to as KNG.
1. Member’s Acknowledgement & Consent
1.1. By acknowledging this Agreement, you confirm that you have entered into this Agreement with KNG and have read, understood, and agreed to all terms herein. “Khao Noi Gym” refers to any gym operated by a member of KNG. All rights and obligations commence from the date of your signature or acknowledgment. If you are under 18, your parent or guardian must sign on your behalf, guaranteeing your performance under this Agreement.
1.2. Your membership starts on the date of purchase of the Membership Fees. You agree to pay all subscriptions, dues, and fees specified, including late charges and administrative fees.
1.3. If payments are made late, KNG may restrict your access to classes and gym facilities as per the “Terms and Conditions” set forth. You authorize KNG to collect any outstanding fees and late charges without further authorization from you.
1.4. This Agreement includes the Terms and Conditions, the “Disclaimer of Liability,” and the Membership Rules and Guidelines (collectively, “Rules and Regulations”), which are incorporated herein by reference. These documents are available at the premises.
1.5. By acknowledging this Agreement, you:
(i) accept and agree to abide by your rights and obligations under this Agreement, the Terms and Conditions, the Disclaimer, and the Rules and Regulations;
(ii) confirm your good physical condition;
(iii) acknowledge you have had sufficient time to review all documents and received satisfactory answers to any questions; and
(iv) confirm receipt of a copy of this Agreement.
2. Terms and Conditions
2.1. The Agreement allows KNG to automatically renew your membership under existing terms and fees upon expiration. You may terminate only with a 14-day written notice and a cancellation fee of 30% of the remaining dues.
2.2. Upon acceptance, you will have access to Khao Noi Gym and its privileges. Unauthorized access or failure to book classes may result in denial of entry and fines.
2.3. Fees may vary based on membership type, purchase location, and time. Fees or dues are as specified in the Fit by Wix app and exclude taxes unless otherwise stated.
2.4. Membership upgrades are available for additional benefits, with payments utilized upon upgrade and not applicable to future obligations.
2.5. Fixed-term memberships include an initiation fee, processing fees, and monthly dues. Initiation fees are non-refundable. KNG reserves the right to increase monthly dues once per year with prior notice. Renewal is required at the end of the term.
2.6. Membership fees are non-refundable and non-transferable, except as stated.
2.7. Fees and dues must be paid timely. Failure to do so may result in denial of entry and legal action for recovery. You agree to indemnify KNG for legal costs incurred in such actions.
2.8. KNG may open or relocate gyms with 30 days’ notice. You must use the nearest or alternative gym and cannot terminate the membership based on relocation.
2.9. Temporary closures for maintenance or unforeseen events will not affect this Agreement. If closure exceeds 30 days and no alternative is within 10 kilometres, your membership will be extended accordingly.
2.10. Only authorized KNG staff may provide KNG Services. You may not provide or solicit such services to/from others.
2.11. To terminate a fixed-term membership, provide at least 14 days' notice before the “Membership End Date.” Premature termination incurs a minimum fee of 30% of remaining dues.
2.12. KNG reserves the right to terminate your membership for breach of terms or any other reason not violating local laws, with or without refund.
2.13. If your gym closes permanently and no alternative is within 10 kilometers, the Agreement terminates with a refund of unused fees. No refund if another gym is nearby.
2.14. Membership termination for related agreement breaches will lead to cessation of access without refunds, and any debts owed will be recoverable.
2.15. Notices will be sent to your registered address or email. Email notices are effective upon transmission; mailed notices are effective three days after posting.
2.16. KNG may amend this Agreement and associated documents at its discretion. You cannot amend the terms unilaterally.
2.17. This Agreement is governed by Singapore law. Any invalid provision does not affect the remainder of the Agreement. No third-party rights under the Contracts (Rights of Third Parties) Act.
2.18. This Agreement constitutes the entire agreement between you and KNG. No verbal or written representations not stated in the Agreement are binding.
3. Disclaimer Waiver of Liability
3.1. You warrant that you are in good physical condition and have no medical conditions that might impair your use of the gym. KNG does not provide medical advice and you should consult a physician if needed.
3.2. You accept all risks associated with gym activities and agree that KNG and its affiliates are not liable for any injuries or damages. This includes indirect, special, incidental, or consequential damages.
3.3. You agree to indemnify KNG and its affiliates against any claims or damages arising from your or your guest’s use of Khao Noi Gym.
3.4. You are responsible for safeguarding your belongings. KNG is not liable for lost or stolen items, including vehicles and their contents.
4. Data Protection Notice
4.1. This Data Protection Notice explains how KNG collects, uses, and discloses personal data according to the Personal Data Protection Act (PDPA).
4.2. Personal data collected may include identification information, contact details, and financial information.
4.3. Data collection is based on your consent or as permitted by law. Your data may be used for various purposes, including providing services, managing relationships, and legal compliance.
4.4. You may withdraw consent for data collection and request data access or correction by contacting KNG’s Data Protection Officer via email (admin@teamkng.com). Withdrawal of consent may affect service provision.
4.5. KNG will protect personal data with appropriate measures but cannot guarantee complete security.
4.6. Personal data will be retained as necessary and may be transferred outside Singapore with your consent.
4.7. Contact KNG’s Data Protection Officer for any queries or requests regarding personal data.
ACKNOWLEDGEMENT AND CONSENT
By signing up a package with KNG, I acknowledge that I have read and understood the Membership Agreement and the Data Protection Notice, and consent to the collection, use, and disclosure of my personal data as outlined.
